Incorrect Treatment or Surgery

If you have been given the incorrect treatment by a Medical Practitioner, you may be able to claim compensation for medical negligence. Examples of the types of claims arising out of incorrect treatment include:-

  • Failure to prescribe the correct medication;
  • Failure to refer the patient to an appropriate specialist;
  • Failure to arrange appropriate tests or investigations;

The above can occur as a result of mistakes in hospital records or treatment for a condition that was considered to be appropriate by a Medical Practitioner, although incorrect. Incorrect operation techniques can also be a cause.

The consequences of incorrect treatment to a patient on whom it occurs can be dire. Consequences involve surgery-associated injuries, death and of great concern are cases which encompass surgery performed on the wrong side or site of the body, wrong surgical procedure performed and surgery performed on the wrong patient.

These can occur in emergency cases where multiple Surgeons are working on a patient, where multiple procedures are involved, time pressures, unusual equipment or set up and room changes.
